TERMS AND CONDITION OF SALE

The web of the URL “majoral.com” (herein, “Majoral”) is the property of ENRIC MAJORAL S.L., a company registered in the Company Register of Barcelona, Volume 28701, Sheet 0066, General Section 1, Inscription 1 and 3, the company address of which is Carrer de Zamora, 91-95, sobreàtic 3ª, Barcelona 08018, with tax number B60982311, (herein “MAJORAL”).

It is important you read these terms and conditions of sale (herein “Conditions of Sale”) before purchasing products through the Majoral website, since this will be ruled by these Conditions of Sale and involves their acceptance.

1. Referring to these Conditions of Sale

These Conditions of Sale are applicable to all the orders and purchases made through the website of Majoral. MAJORAL may, at any time, amend these Conditions of Sale through the publication of the corresponding amendments on the website with the aim of informing the user.

Unless, in accordance with the provisions of current regulations, acceptance of the amendment by the consumer is necessary, any change in the Conditions of Sale will be applicable from the same date of publication of the revised Conditions of Sale or thereafter on this date.

We recommend consulting this page periodically to find out all the changes that apply to you.

As user of the website of the Majoral website, you acknowledge that you have the legal capacity to bind yourself and contract our products and services.

MAJORAL informs that the procedures in order to purchase the products are those described in these Conditions of Sale, as well as other specific ones that are indicated on the screen during navigation so that the client acknowledges and accepts these procedures as necessary to access the products and services offered on the Majoral website.

2. Your account

For the purchase of products through the Majoral website, the user must complete a registration form. Only users aged eighteen (18) or over may register. This registration is free and only the form included in the corresponding section needs to be completed or, during the purchasing process, accepting the terms and conditions.

In accordance with the legislation in force in the Spanish State (Constitutional Law 15/1999 of 13 December and Law 34-2002 of 11 June of Information Services and E-Commerce), we guarantee your privacy and under no circumstances will the data provided by you be passed on to third parties, individuals or companies.

If you create an account (password and username) in the Majoral website, MAJORAL will be responsible for maintaining the confidentiality of your username and password, as well as restricting the access to this data. On creating your account, you promise to accept the responsibility for all the activities and purchases that are made.

The username and password are identifying and enabling elements to accede to and make purchases and have a personal and non-transferable nature.

3. Making an order

To purchase products you must proceed as follows:

·         Read the Conditions of Sale

·         As a registered user, provide your name, address, telephone number, e-mail address, payment details and other legally required information to be able to process your order.

·         Provide a valid delivery address.

·         Have the legal capacity to formalise binding contracts.

 

 

4. Preparation of orders and formalisation of contracts

Once you have formalised your order(s) through the Majoral website, we will send you an e-mail confirming the reception of your order(s) and with the detailed information of the products purchased. The contract is formalised when MAJORAL sends you the delivery confirmation to the e-mail address provided at the time of purchase. Contact the MAJORAL customer service team if you have not received the delivery confirmation during the seven (7) working days after making the purchase.

If you want to change or cancel your order before it has been sent, you must contact the MAJORAL customer service team as soon as possible by means of any option indicated in the contact section.

5. Prices, delivery and handling, taxes and other charges

The price paid for a product will be the current price at the time the purchase is made and will be established in the Confirmation of reception of the order. All the prices will be paid in euros (EUR).

The prices of the product include VAT, but not the delivery costs or taxes applicable to other countries. The delivery and handling costs as well as the corresponding VAT or other taxes, are shown clearly on the screen before completing the order and will be shown again in the Confirmation of reception of the order.

The prices of the products and the delivery and handling costs may change at any time, although the changes will not normally affect the orders for which the Confirmation of reception of the order has already been sent.

6. Payment

The Majoral website has a secure SSL and CES payment system that avoids all possible manipulation of your data when sent by Internet. Your bank details are only legible from the banking entity that acts as the intermediary between you and ENRIC MAJORAL S.L.

Payment will be made through the method you choose during the purchasing process (Credit/debit card, bank transfer, PayPal or Alma, an interest-free fractioned payment system).

For the majority of payment methods, this will be charged to the payment service applicable at the time of formalising the purchase, with all the taxes and delivery costs and/or other possible arising charges included.

The information you provide us with by virtue of this section will be used exclusively to complete the purchasing process and procedures for refunds in the case of cancellation of your order in total or part.

7. Delivery of your order

The estimated delivery time of your order is 3-5 working days and the reception by the buyer will depend on the country of destination. National delivery will be 24 h to 48 h, while the international service may be 4 to 10 days.

You have the possibility of collecting your order at any of our Majoral shops without any additional cost in the transport section during the purchasing process.

If you purchase any article out of stock, our Customer Attention Service  will contact you immediately to inform you, and arrange an approximate delivery date.

Once your order has been sent, you will receive the necessary information for monitoring the delivery.

8. Ownership of the products

The ownership of the products will be that of the purchaser only when MAJORAL has received the full payment for the order, including the taxes, delivery costs and other charges that may arise for the purchase. You assume the responsibility of the products from the time of reception.

 

9. Returns and refunds

·         Right of waiver

In case of exercising your right of waiver, you must inform MAJORAL in a period of not more than seven (7) days from the reception of your order (according to Article 44 of Law 7/1996 of 15 January about Ordering of Retail Commerce amended by Law 47/2002 of 19 December).

In accordance with the applicable regulation (information, waiver and additional charges), you have the right to waiver within a period of thirty (30) days, as from the day following the reception of the products, a period within which you can return the products and request a refund of the amount paid, delivery costs excluded. This right of waiver applies to all products, whether in promotions or otherwise.

The delivery costs of a return are met by the purchaser.

Once MAJORAL has received and validated a returned product, it will confirm to you the validation and the amount corresponding to the returned product and you will be reimbursed. This reimbursement will be made when the following conditions are complied with:

o    The products have not been manipulated inappropriately and which causes a reduction in their value.

o    The original box of the product is also returned without also having suffered unnecessary and inappropriate manipulation.

o    The products cannot be used.

 

The reimbursement of the products returned will only be made to their purchaser and always by means of the same method in which the payment was made. In no case will the addressee of the reimbursement be a different person from the purchaser.

Except in the case that MAJORAL has provided a defective product, we do not accept the return or reimbursement of a product in bad condition and/or shows signs of wear and tear or of having suffered an unnecessary and/or inacceptable manipulation. We only accept the necessary and justified manipulation of the product to establish the characteristics or functioning of it.

 

·         Excluded products

MAJORAL does not accept under any circumstances returns or changes of products purchased in shops that are not its own or of any personalised or manipulated product. You may consult MAJORAL’s own sales points here.

·         Return of defective products

As a consumer you have the right to return a defective product and be reimbursed with the amount paid for the product, plus the delivery costs arising from the procedures necessary to make the return.

To process the return of a defective product, get in touch with the MAJORAL Customer Attention Service and we will inform you of the necessary procedures.

If you need to return a defective product outside the established time limit of thirty (30) days, according to the regulation of the European Union about consumer rights, you must contact the MAJORAL Customer Attention Service or call  +34 933 209 100

10. Guarantee of the Consumer / Responsibility of MAJORAL

MAJORAL guarantees you that any product purchased on its Majoral website fulfils the criteria of rigour and quality required in the manufacture of all its products.

IN NO CASE DO THE CONTENTS OF THESE CONDITIONS OF SALE AFFECT YOUR RIGHTS AS CONSUMER IN AS MUCH AS LEGISLATION PERMITS.

12. Transfer of rights and obligations to third parties

These Conditions of Sale are binding for both you and MAJORAL. They will also be binding for any person or organisation that MAJORAL may transfer its rights and obligations.

You may not transfer or cede in any way your contract with MAJORAL

 

13. Competent Applicable Law

These Conditions of Sale, the relationship between client and MAJORAL, as well as any contract held between MAJORAL and the client, is ruled by Spanish legislation.
